Mr. Miller founded MS&C with Joey Scamardi in 1997. Mr. Miller has litigated and received in excess of 85 jury verdicts in both state and federal court throughout the State of Texas. He has also received the highest individual attorney rating of AV from the Martindale-Hubbell Law Directory, awarded for reaching the highest levels of skill and integrity among attorneys.
Mr. Miller’s vast trial experience and aptitude for narrowing issues and resolving cases with strategic methodology lends itself to a variety of practice areas: personal injury defense, HOA litigation, church liability, professional liability and malpractice defense, first and third-party insurance coverage disputes, and construction defect and premises liability defense. While the majority of civil litigation defense results in resolution, either by dispositive motion or alternative dispute resolution, Mr. Miller’s willingness and ability to litigate before a jury panel enhances his ability to resolve matters often without incurring the expense of trial.
PERSONAL INJURY: Mr. Miller has a vast history of personal injury defense. He has represented both corporate and individual clients in an array of circumstances.
LEGAL MALPRACTICE: Mr. Miller’s extensive experience with legal malpractice defense is reflected in some of his most prominent accomplishments; Mr. Miller represented the firm T. Wade Welch & Associates in a legal malpractice case against OneBeacon Insurance Group. The case was tried and received a verdict of $34,500,000, for the insurance company’s refusal to provide coverage.
COMMERCIAL CASES & CONSTRUCTION DEFECT CLAIMS: Mr. Miller’s ability to litigate large complex commercial cases and construction defect claims, many of which are valued in the millions of dollars, is aided by the relationships he has developed with a wide array of engineering and industry experts; each has the appropriate credentials, specialized training and professional capabilities that are needed to convince judges and juries alike. These relationships translate into considerable savings for his clients.
EMPLOYMENT: Mr. Miller’s specialization in employment disputes focuses primarily on resolution of employment matters such as discrimination and retaliation in the workplace and wage and hour matters. Mr. Miller first appeared before the Department of Labor for a Sarbanes-Oxley claim asserted against his corporate client in 2003. He has further assisted employers with Department of Labor investigations for overtime compensation and resolved these disputes at considerable savings to his clients without the necessity of litigation. Mr. Miller has represented both employees and employers through the administrative proceedings with the Equal Employment Opportunity Commission, (EEOC), including subsequent litigation in both state and federal courts.
Mr. Miller has been invited to speak on several occasions to human resource professionals and business owners regarding employment and labor law issues by professional employer organizations, insurance carriers and brokers. Mr. Miller is also a licensed provider of Continuing Education for insurance adjusters and brokers.
